Purchase Contract BUYERS/SELLERS CONTRACT For the sum of $, Dantero Kennels/Kadi Thingvall (hereinafter referred to as Seller), agrees to sell to of (hereinafter referred to as Buyer), one puppy described below (hereinafter referred to as Dog). This does not include cost of transportation, health certificate, or equipment used for transportation (for example a crate). Dog:Breed: Belgian Malinois Sex: Litter ID: Whelped: Color/Markings: Sire: Dam: Dog: AKC# Registered name of puppy: du Dantero This registered name will appear on all registration papers (not limited to AKC and UKC, but including any other registries Dog is registered with) and will not be changed in any way by Buyer. Buyer can choose any "call name" for Dog they wish. The registered name must begin with the litter id of the litter Dog was born in, and end with "du Dantero" Health Guarantee: Buyer shall have four (4) days from the date Buyer takes possession of Dog to have Dog examined by a licensed veterinarian. If at this time the Dog is found to have a life threatening illness, is not felt to be of the quality represented by Seller, or is not in the state of health agreed to by the two parties, and Dog's current state of health was not brought about by treatment (mistreatment or otherwise) by the buyer, then Buyer may return Dog, with written proof from a licensed veterinarian of the illness, to Seller for a refund of $. All registration papers must be returned with Dog, and be filled out signing ownership of Dog over to Seller, before any refund will be issued. If Dog dies within four (4) days of purchase of an illness contracted while in possession of Seller, Buyer can send to Seller written proof from a veterinarian and receive the above mentioned refund. Any other illness or death which Buyer or an outside party causes (inadvertently or otherwise) Seller is not responsible for, and any refund is at the discretion of Seller. Any veterinarian costs or shipping costs are the responsibility of Buyer. Seller does guarantee that to the best of my knowledge said dog is free of life threatening health problems. If, prior to Dog's 4th birthday, Dog is found to have a genetic health defect (such as Hip Dysplasia, Elbow Dysplasia, Von Willebrand's, etc.) that effects the dogs quality of life*, Dog may be returned to Seller, with written proof from a licensed veterinarian (or OFA, CERF, etc.) of the defect, for a replacement puppy. In the case of a replacement pup, Buyer is responsible for any and all transportation costs for both Dog, and the replacement pup. The replacement puppy will be chosen by Seller from Seller's next litter, and will be of equal or higher quality than the quality the original puppy was sold as. (i.e. if Dog was sold as pet quality, the replacement puppy will also be pet quality or better)However, the same restrictions as the original sale will apply. (i.e. if Dog was sold as pet quality, even if replacement is working quality, Dog will still come with limited registration and a spay/neuter contract, unless other arrangements are made) If Buyer chooses to keep Dog (any option other than returning Dog to Seller will be considered "keeping" of Dog i.e. if Dog is sold, given away, or "put to sleep") a refund of 1/2 of the dogs purchase price will be given, but only after proof of spay/neuter of Dog has been supplied. Dogs sold as potential show and/or working quality do not come with a guarantee that they will achieve any titles, Seller has no control over the training and competition of these dogs. Registration/Grading: Dog has been graded and sold as potential quality (pet / show / working). If dog receives a grading of pet quality (or dog is sold specifically as a pet), Buyer agrees that Dog will be registered on an AKC Limited Registration, and spayed/neutered between 18 and 24 months of age. If dog is spayed/neutered prior to 18 months of age, all health guarantees in this contract are void. If dog is a female and is sold as working and/or show quality, dog will be registered on an AKC Limited Registration. AKC Limited Registration papers will be changed to Full Registration after the dog has received a passing OFA, PennHip, or similar organizations rating for hips and elbows, passed a CERF exam, and achieved a working title at Seller's expense. Titles that qualify for a change in registration are PSA1, FRI, MRI, IPG1, or a level 1 herding title (examples are HSA, HSB, HRDI, HTDI, RLFI, any stock). Other titles such as obedience, agility, or conformation are at Seller's discretion. Buyer agrees to provide Seller with Photographs suitable for advertising and photocopies of all awards and critiques along with the judge(s) name(s) and the Club sponsoring the show. Buyer also agrees that Seller may use the photographs and any particulars of qualifying awards in any future advertising. Buyer agrees Seller will REPOSSESS DOG UPON EVIDENCE OF NEGLECT, ABUSE, OR ANY VIOLATION OF THE CONTRACT at no expense to the seller. All registration papers for Dog will be signed over to Seller. Buyer certifies that this dog is being purchased for a personal dog and that Buyer is not acting as a broker or agent with the intent to resell the puppy. If at any time during Dog's life Buyer decides to give Dog up (sell, place, give away, etc.) Buyer will give Seller first right of refusal to purchase Dog back, for the purchase price listed above. Seller will be responsible for all reasonable transportation costs if Seller chooses to purchase Dog. If Dog is to be air shipped to Buyer by Seller, Buyer pays for all shipping related costs (health certificate, crate, etc.). Dog's having grade 1 are not affected with vision problems, however they should not used for breeding. Those affected with grades 3 to 6 have increasingly poor vision which can lead to blindness.
